1. Agreement to Terms

By accessing or using Restless OS ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, you may not access the Platform.

2. Description of Service

Restless OS is an internal creative intelligence platform developed by Restless Agency. The Platform provides:

  • Aggregation of advertising performance data across multiple platforms
  • AI-powered analysis of creative assets and performance correlations
  • Generation of creative insights, personas, and recommendations
  • Dashboard visualizations and reporting capabilities

The Platform is designed exclusively for internal agency use and authorized client access.

3. Eligibility

Access to Restless OS is restricted to:

  • Authorized employees and contractors of Restless Agency
  • Client representatives who have been granted explicit access
  • Third-party partners with valid access agreements

Unauthorized access or use of the Platform is strictly prohibited and may result in legal action.

4. User Responsibilities

As a user of the Platform, you agree to:

  • Maintain the confidentiality of your login credentials and not share them with unauthorized parties
  • Use the Platform only for its intended purpose of creative intelligence and performance analysis
  • Protect the confidentiality of client data accessed through the Platform
  • Report any security vulnerabilities or suspicious activity immediately
  • Comply with all applicable laws and regulations in your use of the Platform

5. Acceptable Use

You agree NOT to:

  • Attempt to gain unauthorized access to any portion of the Platform or its related systems
  • Use automated tools to scrape, extract, or collect data from the Platform without authorization
  • Share, distribute, or publish any confidential data obtained through the Platform
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use the Platform to violate any third-party rights, including intellectual property rights
  • Introduce malware, viruses, or other harmful code to the Platform
  • Interfere with or disrupt the integrity or performance of the Platform

6. Intellectual Property

Platform Ownership: Restless OS, including its design, features, code, and documentation, is the exclusive property of Restless Agency. All rights reserved.

Client Data: Clients retain full ownership of their data, including advertising performance data, creative assets, and any materials uploaded to the Platform.

Generated Content: AI-generated insights, personas, and recommendations created through the Platform are licensed to the applicable client for their business use.

7. Third-Party Services

The Platform integrates with third-party services including Meta, TikTok, Google, AppsFlyer, and OpenAI. Your use of these integrations is subject to the respective third-party terms of service:

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Implied warranties of merchantability or fitness for a particular purpose
  • Warranties that the Platform will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of AI-generated insights

AI-generated content should be reviewed and validated by human users before being used for business decisions.

9. Limitation of Liability

To the maximum extent permitted by law, Restless Agency shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, business, or goodwill
  • Damages arising from reliance on AI-generated insights or recommendations
  • Service interruptions or data loss

Our total liability shall not exceed the amount paid by you (if any) for access to the Platform in the twelve months preceding the claim.

10. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice, for any reason, including:

  • Breach of these Terms
  • End of employment or contractual relationship with Restless Agency
  • Revocation of client access by the account owner
  • Suspected security breaches or unauthorized activity

Upon termination, your right to use the Platform will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.
